Project Details


The appeal of annulment for the Council of State is unique for the jurisdictional legal protection of the citizen in Belgium. Therefore, the legal grounds that can be put forward within the scope of such an appeal of annulment, will be specific to a large extent.Successively, the project inquires into:1) the typical character of the concept of 'ground', as it is mentioned in the regulations of procedure of the Council of State, administration department and the forms of illegality, which in this context, must be taken into account.2) the possible classifications of illegalities and the relation between the form of illegality and the scope of annulment.3) the admissibility of the ground in the light of the specificity of the procedure;4) the authority of the Council of State to raise grounds by virtue of its office.
