Approximations to energy from a Cuban legal perspective

Abstract

According to the first principle of thermodynamics, energy is neither created nor destroyed and has therefore been permanently present in the life of man, guaranteeing his existence and the development of society. Taking into account the undeniable relevance of energy for man, society and the state, the legal understanding of energy is a process that has been going on since the dawn of humankind. In this sense, the study of energy from a scientific point of view has transcended the most dissimilar fields and edges. The understanding of this category from a legal approach has been subject to debate on an international scale, while in the Cuban legal-doctrinal sphere, there are few studies aimed at achieving a legal approach to energy. From a legal perspective, the definition of energy, as well as the determination of its legal nature, are aspects of special interest to improve the legal regulation of its production, commercialisation, distribution and consumption. This paper aims to systematise the theoretical and legal foundations of energy as a transdisciplinary category to strengthen Cuban legal doctrine. Legal-historical, legal-doctrinal and legal-analytical research methods will be used.
