Abstract

This chapter delves into constitutional questions of the legal distribution of power and jurisdiction over subjects and territories among European polities. It discusses the formation of territorial states (e.g. rules of succession and legitimate holding of territory, competition between realms over jurisdiction), territorial disputes and acquisition (expansion) and border management. It explains the major legal doctrines as well as the interactive dynamics of practice. It considers European doctrines and practices both in Europe and the Indies.
