Abstract

Considering the rising number of prisoners without a legal permit of residence or so called 'undocumented prisoners', who are exposed to deportation measures under the Immigration and Penitentiary law, this paper aims to critically evaluate the concept 'rehabilitation' that lies at the basis of changes in the Belgian penitentiary law during the last decade. Drawing on data of the Ministry of Justice and the Office of Foreigners' Affairs, the population of irregular migrants will be described and the way rehabilitation is realized towards undocumented prisoners in Belgium will be discussed. It will be argued that more attention to the specific characteristics and the composition of the prison population is desirable to realize a rehabilitative penal policy.
