Abstract

-The liner shipping industry is characterised by substantial investment costs and a high
level of concentration.
- Since 1995, special rules exist for liner shipping companies allowing them to cooperate
and jointly operate services, under certain conditions, for the optimisation of vessel
capacity.
- While the special rules, subsequent exemption regulation and its updates and
prolongations have been in place for almost 30 years, the European Commission
recently decided not to further prolong the measure. This means that the sector will in
the future have to apply the regular antitrust rules applicable to all industries.
- This note reviews the history and evolution of the consortia block exemption for liner
shipping and reflects on the consequences of its expiry.
