THE RIGHT TO AN ADEQUATE FOOD, CHALLENGES AND PERSPECTIVES IN THE CUBAN CONSTITUTION LIGHT

Abstract

This research entitled: the right to an adequate food, challenges and perspectives in the Cuban constitution light, deals with the new dimensions granted to this right by the Magna Carta of 2019. Food regulation as a right in the Constitution is not a casuistic fact, but rather a Cuban State political commitment reflection at the national and international level. Therefore, it is in the current Constitution that the subject is expressly recognised for the first time, highlighting the State obligation to strengthen population food security. This is an economic and social right with progressive nature, marked in an ascending order for its full realisation, although the non-retrogression principle is applicable in the measures taken for its fulfilment. The main objective lies in assessing the central challenges that the regulation of this right signifies for the legal system, society and the State under 2019 Constitution prism. The above scenario is based on the need to define the subjects, object, content, principles and guarantees that make it up, starting from fundamental rights theory. Main result is based on substantiating the right to an adequate food significance and scope in Cuban legal panorama.
