Abstract

In February 2009 the European Commission published the "Guidance on
the Commission's enforcement priorities in applying Article 82 (now 102)
of the EC Treaty to abusive exclusionary conduct by dominant undertakings".
1 The guidance paper first describes the economic and effect-based
approach that will guide the Commission in the assessment of exclusionary
practices and then presents an analytical framework for the assessment
of the most common examples of exclusionary conduct, including
tying and bundling.
This CCR identifies the most important insights of the economic literature
on tying and bundling and presents the Commission approach to the
assessment of potential foreclosure effects of tying an bundling strategies
by dominant firms.
