This Master’s thesis analyses the legal regulation of agrarian property in Cuba, focusing on the contradiction between the constitutional recognition of private property (2019 Constitution) and the restrictions imposed on small farmers’ right to dispose of land. Using a doctrinal, historical and comparative legal approach, the study examines the evolution of agrarian property and the role of the social function of land in shaping limitations on ownership rights. The research critically assesses Cuban agrarian legislation and administrative practices that restrict land transfer, inheritance and productive autonomy, arguing that these constraints undermine legal certainty and the effective enjoyment of property as an economic and social right. The thesis concludes that greater normative harmonisation between constitutional principles and agrarian law is required to strengthen farmers’ rights, autonomy and socio-economic development
