Clarifying the Scope and Application of the Principle of Universal Jurisdiction

At the fifty-fourth session of the International Law Seminar, the Working Group on Universal Jurisdiction worked under the supervision of Professor Charles C. Jalloh, Member of the International Law Commission. I was one of the reporters. The Working Group was tasked with addressing four main issues: (i) the main issues/gaps/controversies in the current understanding, interpretation and application of the universal jurisdiction principle amongst states: legal or policy proposals to address such concerns; (ii) How might the Commission’s approach to the topic be distinguished from the current work on universal jurisdiction in the Sixth Committee of the General Assembly; (iii) the reason to think that the majority of States, which are already engaged in consideration of universal jurisdiction in the Sixth Committee, would be receptive or unreceptive to the Commission’s work on the topic; (iv) Should the ILC choose to embark on a study of universal jurisdiction, and having in mind its mandate under its statute as well as its practice, what might the best form for the ILC proposed clarification of the scope and application of universal jurisdiction: a new global convention, reach conclusions, prepare guidelines or restate the principles governing universal jurisdiction?
