Description

Intervention before the Société d'Histoire du Droit (Ecole de Droit de la Sorbonne, Place du Panthéon/Rue Soufflot, Salle des Conseils) on the legal quarrel concerning the Imperial Company established in Ostend for trade with the East Indies (1722). In a first section, I summarise the bilateral debate, which pitted the Dutch Republic against the Austrian Low Countries. In a second section, I discuss the impact of the "Ripperda" treaties of April and May 1725, whereby the King of Spain recognised the Imperial East Indies Company of Ostend and extended British and Dutch trading privileges to the subjects of Charles VI. This construction nearly brought Europe to a general war. The road to the Parisian Preliminaries and the Congress of Soissons show that the Dutch point of view did not necessarily prevail "on the merits", but was taken over for commercial considerations, as Dutch help in safeguarding French merchants' assets on the Spanish Galeons was of prime importance to Chauvelin and Fleury.
