The presentation examined the extent to which human rights law contributes to the emergence of an obligation to prosecute or extradite in international law beyond the limited scope of treaties. Focusing on the proceduralisation of substantive rights, it assessed how this judicial activism has so far broadened the scope of state obligations, in particular by imposing on states a procedural obligation to prosecute or extradite.
