Samenvatting

This article discusses the role of patent eligibility in patent theory; the relationship it has in balancing access and incentive in the patent system. It further investigates the Boards of Appeal case law with regard to patent eligibility. It examines the advent of the 'any technical effect' doctrine, its current application and its effect for the inventive step assessment. The article concludes that this doctrine has undermined the gatekeeping function of patent eligibility and the legitimacy of the patent system as a whole.
