Samenvatting
The worrying global energy situation, characterised by a constant increase in demand, pollutant emissions and energy prices, as well as the inevitable depletion of fossil fuels, has generated in recent years a widespread awareness of the need to develop sustainable energy solutions. The present research makes an approach to the legal and institutional framework of Power Purchase Agreements, its regulation in the international framework and its novelty in the Cuban legal system. Throughout the research, the aim is to substantiate the need to regulate these contracts in pursuit of sustainable energy development. Through research methods such as legal-doctrinal, historical-legal, analytical-legal and document analysis, the research was provided with an adequate theoretical-conceptual basis, the genesis and historical evolution of the regulation of this particular issue, as well as a technical analysis of the legal norms in this area in order to determine the regulatory deficiencies of this institution in Cuba, moreover the scope of its regulation in the legislation. This research concludes by demonstrating the necessary legal regulation of this contractual figure, as it constitutes a vital element within the aspirations of energy sovereignty of the countries, of clean energy generation projects by means of Renewable Energy Sources. In this context, the Cuban legal-energy system with regard to energy supply contracts is making good progress, although it must continue to be perfected.
